Terms of sale for consumer purchases

 


 

 

1. Introduction
These sales conditions govern the purchase of goods in LASER SOLUTIONS online store (the "Online Store") where the buyer acts as a consumer, and are part of the agreement between LASER SOLUTIONS and the buyer. If the buyer is not a consumer, LASER SOLUTIONS sales conditions apply to sales to businesses.

Consumer purchases only exist where the buyer is considered a consumer in the trade in question according to the legislation. This normally requires that the buyer is a natural person who does not mainly act as part of business activities.

Consumer purchases over the internet are mainly regulated by the Contracts Act, the Consumer Purchases Act, the Marketing Act, the Right of Cancellation Act and the E-commerce Act. These laws give the consumer inalienable rights and are available at www.lovdata.no . The terms of this agreement shall not be understood as any limitation in the consumer's statutory minimum rights.

The buyer is the consumer who is indicated as the buyer in the order form, and is LASER SOLUTIONS to as "online store". If the order is made by another person on behalf of the buyer, that person guarantees that they have sufficient powers. 
The parties to the trade and the agreement are the buyer and LASAERSOLUTIONS
.

3 The agreement
The agreement consists of these terms and conditions of sale, information provided in the Online Shop and when ordering, and any other terms agreed in writing. LASER SOLUTIONS does not accept unilateral terms or conditions from the buyer beyond the standard information and choices that follow from the order form. In the event of a conflict, what is separately agreed between the parties takes precedence, as long as it does not conflict with non-derogable legislation. The agreement will also be supplemented by relevant legal provisions that regulate the purchase of goods between traders and consumers.

The agreement is binding for both parties when the buyer has sent their order to LASER SOLUTIONS through the Online Store and the order has been confirmed by LASER SOLUTIONS through an order confirmation or similar message. Notification that the order has been received is not considered order confirmation.

The agreement is nevertheless not binding if errors have occurred in the Online Shop, or in advertisements, correspondence or the like from LASER SOLUTIONS, and the buyer realized or should have realized that there was such an error. LASER SOLUTIONS also reserves the right to cancel an order, or parts of it, if the item is sold out. If a limitation has been specified in connection with an offer, for example by the number of copies per customer or household being limited, orders that individually or collectively exceed the limitation may be canceled by LASER SOLUTIONS even if the buyer has received an order confirmation or similar.

LASER SOLUTIONS will give notice of situations as mentioned in the paragraph above in connection with its processing of the order, at the latest upon dispatch. In the event of an error, LASER SOLUTIONS will normally also offer the buyer to carry out the transaction on corrected terms.

The item may also be subject to contractual terms from the manufacturer or other third parties, such as manufacturer warranties, licenses and subscription terms. LASER SOLUTIONS is not a party to such agreements, nor does it accept any responsibility for them.

LASER SOLUTIONS reserves the right to change prices and other information for goods in the Online Shop, including promotions, without notice. It is the price and information for the item at the time of order that forms the basis of the agreement with the buyer at all times.

4 Price
The prices in the online store include VAT and exclusive shipping.

Information about the total costs the buyer must pay, including all taxes (value added tax, customs, etc.) and delivery costs (freight, postage, invoice fees, packaging etc.) as well as specifying the individual elements in the total price, is provided in the order solution in the Online Shop before the order is placed undertaken.

For deliveries to NORWAY, as well as orders to addresses outside Norway, special prices and conditions may apply.

5 Payment
LASER SOLUTIONS can demand payment for the item when it has been sent from LASER SOLUTIONS to the buyer. Payment is made via the payment method chosen by the buyer in connection with the order.

If the buyer uses a credit or debit card for payment, LASER SOLUTIONS can reserve the purchase price on the card when ordering. The card is charged on the same day the item is ordered. The same applies to similar payment solutions where the settlement takes place through a third party.

When paying by invoice, the invoice is issued to the buyer when the goods are ORDERED. The payment deadline appears on the invoice and is a minimum of 14 days from receipt. LASER SOLUTIONS can require a credit check for payment by invoice. Buyers under the age of 18 cannot pay with a subsequent invoice.

In the event of delayed payment, the statutory late payment interest accrues, in addition to dunning and collection fees according to the statutory rates.

LASER SOLUTIONS has a lien on the goods until the purchase price, including interest and costs, has been paid in full.

LASER SOLUTIONS can assign its claim for payment to a third party.

6 Levering

LASER SOLUTIONS delivers the goods to the delivery address that appears in the buyer's order, using the shipping method specified in the order or otherwise agreed. LASER SOLUTIONS only offers and accepts the delivery addresses and methods that can be specified in the order solution in the Online Shop. Delivery to addresses outside Norway, or to NORWAY, requires special approval from LASER SOLUTIONS.

Delivery has taken place when the buyer, or the buyer's representative, has taken over the goods. In case of delivery to mailboxes, delivery is considered to have taken place when the item is delivered to the mailbox. If the buyer orders delivery to an address other than his own, or to a person other than himself, the same applies for such delivery.

If the delivery time is not specified in the order solution, LASER SOLUTIONS must deliver the goods to the buyer without undue delay and no later than 30 days after the order from the buyer. It is emphasized that all delivery times specified in the Online Shop must be considered indicative, and not binding. LASER SOLUTIONS does not take responsibility for delays caused by the charterer or circumstances beyond LASER SOLUTIONS control.

The risk of the item's loss or destruction passes to the buyer upon delivery. If the buyer fails to take over an item that has been placed at the buyer's disposal according to the agreement, the buyer still bears the risk of loss or damage due to the characteristics of the item itself.

The buyer should check as soon as possible after delivery whether the delivery is in accordance with the order, including that there is no transport damage or deviations in quantity, etc. Any deviations should be reported to LASER SOLUTIONS as soon as possible.

If the buyer fails to pick up the goods at the agreed place, including that the goods are returned to LASER SOLUTIONS because the deadline for collection from the charterer has been missed, or that the goods are not collected within 14 days where collection from LASER SOLUTIONS has been agreed, LASER SOLUTIONS will charge the buyer a fee for to cover LASER SOLUTIONS actual expenditure to deliver the goods to the buyer and consider the order as. The fee will constitute return shipping costs.

7 Installation, user support and maintenance
The buyer is responsible for and must pay for any assembly and installation of the item. For electrical equipment intended to be part of a fixed electrical installation, the installation must be carried out by a registered installation company.

LASER SOLUTIONS does not normally provide any user support for goods purchased in the Online Store, but the buyer gets access to any user support from the manufacturer to the extent that the manufacturer offers this, on the terms the manufacturer has for this. To the extent that LASER SOLUTIONS customer service offers user support for the item, this is done to the best of its ability and subject to availability.

Maintenance of the item is the buyer's responsibility. The manufacturer's instructions should be followed, and damage caused by inadequate maintenance does not constitute a defect. LASER SOLUTIONS points out that the manufacturer's guarantees may require the use of an authorized workshop and authorized parts etc.

8 Right of withdrawal

8.1 Right of cancellation
Unless the agreement is exempt from the right of cancellation, the buyer can cancel the purchase of the goods in accordance with the Right of Cancellation Act. Section 22 of the Right of Withdrawal Act specifies which agreements are exempt from the right of withdrawal.

The cancellation period begins to run as follows:

  • When purchasing individual goods, the cancellation period will run from the day after the goods have been received.

  • If a subscription is sold, or the agreement involves regular delivery of identical goods, the deadline runs from the day after the first shipment is received.

  • If the purchase consists of several deliveries, the cancellation period will run from the day after the last delivery has been received.

The buyer can try or test the goods in a proper way to determine the nature, properties and function of the goods, without the right of withdrawal being lost. If testing or testing of the goods goes beyond what is reasonable and necessary, the buyer may be held liable for any reduced value of the goods.

The buyer must notify LASER SOLUTIONS  of the use of the right of withdrawal within 14 days of the deadline starting to run. The deadline includes all calendar days. If the deadline ends on a Saturday, holiday or bank holiday, the deadline is extended to the nearest working day. The withdrawal period is deemed to have been met if notification is sent before the end of the period. The buyer has the burden of proof that the right of withdrawal has been exercised, and the notification should therefore be made in writing (right of withdrawal form, e-mail or letter).

The withdrawal period is extended to 12 months after the expiry of the original period if LASER SOLUTIONS does not inform that there is a right of withdrawal and a standardized withdrawal form before the conclusion of the agreement. The same applies in the event of a lack of information on terms, deadlines and procedures for exercising the right of withdrawal. If LASER SOLUTIONS ensures that the information is provided during these 12 months, the cancellation period still expires 14 days after the day the buyer received the information.

When exercising the right of withdrawal, the goods must be returned to LASER SOLUTIONS without undue delay and no later than 14 days from the notification of exercise of the right of withdrawal being given. The buyer covers the direct costs of returning the item, unless otherwise explicitly stated in the agreement. LASER SOLUTIONS cannot set a fee for the buyer's use of the right of withdrawal.

LASER SOLUTIONS is obliged to repay the purchase price to the buyer without undue delay, and no later than 14 days from LASER SOLUTIONS receiving notification of the buyer's decision to exercise the right of withdrawal. LASER SOLUTIONS has the right to withhold payment until LASER SOLUTIONS has received the goods from the buyer, or until the buyer has submitted documentation that the goods have been returned.

8.2 Right of withdrawal for goods with installation
The right of withdrawal also applies to goods purchased with installation, but the customer must cover all costs related to disassembly and return. The customer also accepts that changes to material and property as a result of the installation must be reset by the customer at their own expense. For example, drilling a hole in the wall for the installation of a home charger.

9 Buyer's rights in the event of LASER SOLUTIONS default

9.1 Delay or non-delivery

9.1.1 General
If LASER SOLUTIONS
 does not deliver the item, or delivers it too late, and this is not due to the buyer or conditions on the buyer's side, the buyer may, depending on the circumstances, withhold the purchase price, demand fulfillment, terminate the agreement and/or demand compensation from LASER SOLUTIONS according to the rules in Chapter 5 of the Consumer Purchase Act.

9.1.2 Fulfillment
The buyer can maintain the purchase and demand fulfillment from LASER SO
LUTIONS, unless there is an obstacle that LASER SOLUTIONS cannot overcome, or if fulfillment will entail such a great disadvantage or cost for LASER SOLUTIONS that it is significantly out of proportion to the buyer's interest in that LASER SOLUTIONS meets. Should the difficulties disappear within a reasonable time, the buyer can still demand fulfillment.

The buyer loses his right to demand fulfillment if the buyer waits an unreasonably long time to make the claim.

9.1.3 Cancellation
If LASER SOLUTIONS does not deliver the goods at the agreed time, the buyer must call on LASER SOLUTIONS to deliver within a reasonable additional deadline for fulfillment. If LASER SOLUTIONS does not deliver the goods within the additional deadline, the buyer can cancel the purchase.

However, the buyer can cancel the purchase immediately if LASER SOLUTIONS refuses to deliver the item. The same applies if delivery at the agreed time was decisive for the conclusion of the agreement, or if the buyer has notified LASER SOLUTIONS that the time of delivery is decisive.

If the goods are delivered after the additional deadline set by the consumer or after the time of delivery which was decisive for the conclusion of the agreement, a claim for cancellation must be made within a reasonable time after the buyer became aware of the delivery.

9.1.4 Compensation
The buyer can claim compensation for loss suffered as a result of delay, LASER SOLUTIONS confirms that the delay is due to an obstacle beyond LASER SOLUTIONS control which could not reasonably have been taken into account at the time of the agreement, avoided or overcome the consequences of. Chapter 11 of the Consumer Purchase Act contains detailed rules on compensation calculation etc.

9.2 Missing

9.2.1 General
If there is a defect in the goods, the buyer must notify LASER SOLUTIONS
 within a reasonable time after it was discovered or should have been discovered that the buyer is claiming the defect.

The buyer has always complained in sufficient time if it happens within two months of the defect being discovered or should have been discovered. Complaints can normally be made no later than two years after the buyer took over the item. If the product or parts of it are intended to last significantly longer than two years, however, the complaint period is five years.

If the item has a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer can, depending on the circumstances, withhold the purchase price, choose between rectification and redelivery, demand a price reduction, demand the agreement terminated and/or demand compensation from LASER SOLUTIONS in accordance with the rules in the Consumer Purchase Act, Chapter 6.

The buyer must not send goods for correction at LASER SOLUTIONS without further agreement with LASER SOLUTIONS. Upon submission, the buyer is responsible for packing the item properly. The buyer bears shipping costs and LASER SOLUTIONS reasonable investigation costs associated with unjustified complaints. LASER SOLUTIONS can withhold the goods until such costs have been paid.

9.2.2 Rectification or redelivery
The buyer can choose between demanding the defect rectified or delivery of equivalent items. LASER SOLUTIONS can nevertheless object to the buyer's claim if the implementation of the claim is impossible or causes LASER SOLUTIONS
 unreasonable costs. Correction or redelivery must be made within a reasonable time. In principle, LASER SOLUTIONS does not have the right to make more than two remedial attempts for the same deficiency.

LASER SOLUTIONS does not reimburse the buyer's costs for its own repair measures or third-party repairs or investigations, unless these are incurred as a result of LASER SOLUTIONS having breached its rectification obligations or this has been agreed in writing with LASER SOLUTIONS.

LASER SOLUTIONS can request that the buyer address claims for correction or redelivery directly to the manufacturer where this is most appropriate.

9.2.3 Price discount
The buyer can demand a suitable price discount if the item is not corrected or re-delivered. This means that the ratio between the reduced and agreed price corresponds to the ratio between the value of the goods in defective and contractual condition. If there are special reasons for this, the price discount can instead be set equal to the significance of the defect for the buyer.

9.2.4 Cancellation
If the goods have not been corrected or re-delivered, the buyer can also cancel the purchase whe
n the defect is not insignificant.

10 LASER SOLUTIONS rights in the event of a buyer's default

10.1 General
If the buyer does not pay or fulfill the other obligations according to the agreement or the law, and this is not due to LASER SOLUTIONS or conditions on LASER SOLUTIONS side, LASER SOLUTIONS may, depending on the circumstances, withhold the goods, demand fulfillment of the agreement, demand the agreement be canceled and demand compensation from the buyer according to the rules in the Consumer Purchase Act, Chapter 9.

LASER SOLUTIONS will also be able to charge interest for late payment, debt collection fees and a reasonable fee for undelivered goods.

10.2 Fulfillment
LASER SOLUTIONS can maintain the purchase and require the buyer to pay the purchase price. If the goods are not delivered, LASER SOLUTIONS
 loses its right if LASER SOLUTIONS waits an unreasonably long time to make the claim.

10.3 Termination
LASER SOLUTIONS can terminate the agreement if there is a significant payment default or other significant default on the part of the buyer. However, LASER SOLUTIONS
 cannot withdraw if the entire purchase price has been paid. If LASER SOLUTIONS sets a reasonable additional deadline for fulfillment and the buyer does not pay within this deadline LASER SOLUTIONS can cancel the purchase.

10.4 Default in payment
If the buyer does not pay the purchase price in accordance with the agreement, LASER SOLUTIONS can demand interest on the purchase price in accordance with the Late Interest Act. In the event of non-payment, the claim may, after prior notice, be sent to the Buyer, who may then be held liable for fees in accordance with the Debt Collection Act.

11 Guarantees
For some goods, the manufacturer will give a guarantee relating to the goods' properties, performance and durability, etc. The extent of the warranty must be determined based on the individual warranty statement, and there will normally be conditions for exercising the warranty related to installation, use and complaints within given deadlines etc.

LASER SOLUTIONS is not responsible for guarantees that have not been issued by LASER SOLUTIONS, nor does it guarantee that such guarantees give the buyer better rights than the buyer's statutory rights. In any case, a guarantee does not imply any restrictions on the buyer's right to claim and claim in the event of delay or defects according to point 9.

Shipping costs and other costs in connection with warranty claims are covered by the buyer, or the manufacturer if this follows from the warranty.

12 Personal data
LASER SOLUTIONS is responsible for the processing of personal data collected in connection with the trade. Personal data is processed in accordance with LASER SOLUTIONS.

If, in connection with the transaction, the buyer provides personal information about someone other than himself, the buyer warrants that there is a valid processing basis for this, for example in the form of consent from the data subject or a legitimate interest.

 

13 Communication
The buyer accepts LASER SOLUTIONS use of electronic communication for all inquiries related to the trade. Electronic communication to the e-mail address provided by the buyer at the time of the order is considered validly sent to the buyer.

When making inquiries to LASER SOLUTIONS, the buyer must use the addresses and communication methods given in the Online Shop relating to the inquiry in question. In the event of a complaint or demand for rights of default, the notification should be in writing (e.g. e-mail) for reasons of evidence, and reference should be made to the order number.

In the event of inquiries, LASER SOLUTIONS may require the buyer to verify their identity and that the item was purchased in the Online Shop.

 

14 Changes to the terms and conditions

 LASER SOLUTIONS reserves the right to change these terms and conditions of sale without notice. It is always the terms of sale at the time of order that apply.

 

15 Choice of law and conflict resolution
The agreement is governed by Norwegian law.

The parties shall attempt to resolve any disputes amicably, and complaints shall be directed to LASER SOLUTIONS within a reasonable time, cf. points 9 and 10. If this is not successful, the buyer may contact the Consumer Council for mediation. The Consumer Council is available on phone 23 400 500 or www.forbrukerradet.no .

The European Commission's complaints portal can also be used to lodge a complaint. It is particularly relevant for consumers residing in an EEA country other than Norway. The complaint is submitted here: http://ec.europa.eu/odr . 
Disputes can also be brought before the ordinary courts in Norway.

After-sales Service

 

Warranty time: The company provides a 12-month warranty period for the product components including the power supply, touch screen and body (the treatment applicator warranty period is 3 months), and the warranty period starts from the date of purchase.

★ Warranty:

Our company provides free maintenance and free spare part when problem occurs during the warranty time. The product damage caused by improper use and other irresistible factors is not covered by the warranty.

★ Warranty restrictions:

1) Users enjoy free warranty service during the warranty period.

2) Man-made damage is not covered by the warranty.

3) When the product is returned, if the product is damaged due to improper packaging, the product will no longer enjoy free warranty service.

4) Products accepted for maintenance still enjoy the original warranty time and services. If the shelf life of the repaired or replaced product is less than 3 months, it will enjoy 3 months warranty service from the date of repair.

5) After the parts are replaced, the original faulty parts shall belong to our company.

6) The user shall be properly responsible for the security of his own data, and the company shall not be liable for any damage or loss of data or programs that may be caused during the maintenance process. At the same time, the user must keep the warranty card and purchase certificate properly. If it is damaged or lost, the company will not be able to provide the warranty card or purchase certificate again.

 

After-sales Service

If the product is damaged due to the following circumstances, the company will no longer be responsible for the product warranty.

a. Damage caused by fire, earthquake, third-party behavior (other than customers and our company's maintenance personnel), intentional or misuse by users, unpredictable events, and other abnormal conditions.

b. Damage caused by failure to follow the instructions in this user manual.

c. Other situations include: situations beyond the company's control, problems caused by users using accessories from other companies, or accepting unauthorized modifications and services; misuse and abuse of machines during operation or maintenance, or failure to follow the instructions in this manual to disassemble the machine by yourself.

d. Damage caused by non-compliance with the specified operating environment, including damage caused by excessive workload.

e. Damage caused by improper storage environment (such as biting by rodents, liquid infiltration, etc.).

f. Damage resulting from the use of self-written or non-publicly available applications
